By accessing and using the WhaleWealth platform ("Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, you should not use the Service.

WhaleWealth reserves the right to modify these terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of modified terms.

2. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

3. User Roles

The Service supports the following user roles:

• Customer: Can browse, purchase courses and products, leave reviews, and manage orders.
• Vendor/Instructor: Can list and sell courses, digital products, physical products, and services. Subject to vendor agreement and commission rates.
• Admin: Platform administrators who manage the marketplace.

4. Purchases and Payments

All prices are displayed in Thai Baht (THB). Payment methods include PromptPay, bank transfer, and supported online payment gateways. By making a purchase, you agree to pay the listed price plus any applicable taxes or fees.

Digital products and course enrollments are delivered immediately upon successful payment confirmation. Physical products are shipped according to the vendor's stated delivery timeline.

5. Refund Policy

WhaleWealth offers a 30-day money-back guarantee on most purchases. Refund eligibility is subject to our Refund Policy. Certain exceptions may apply for:

• Courses with more than 30% content consumed
• Downloaded digital products after first download
• Custom or personalized services that have been delivered

6. Vendor Terms

Vendors who list products and courses on WhaleWealth agree to:

• Provide accurate descriptions and pricing for all listings
• Deliver products and services as described
• Respond to customer inquiries within 48 hours
• Comply with all applicable Thai laws and regulations
• Pay the agreed commission rate on each sale
• Not list prohibited or illegal content

7. Intellectual Property

Course content, product listings, and all materials uploaded by vendors remain the intellectual property of their respective creators. By listing on WhaleWealth, vendors grant the platform a non-exclusive license to display and distribute content as needed to operate the marketplace.

Customers receive a personal, non-transferable license to access purchased content. Sharing, redistributing, or reselling purchased content is strictly prohibited.

8. Prohibited Activities

You may not use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious code or viruses
• Engage in fraud or deceptive practices
• Harass other users
• Create fake accounts or reviews
• Scrape or extract data without authorization

9. Limitation of Liability

WhaleWealth is a marketplace platform that connects buyers and sellers. We are not responsible for the quality, safety, or legality of products and courses listed by vendors. We make no warranties, express or implied, regarding the Service.

To the maximum extent permitted by Thai law, WhaleWealth's total liability shall not exceed the amount you paid for the relevant product or service.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangkok, Thailand.
